Resource Management Inc. ("RMI") is committed to respecting the privacy of our users. We want to provide a safe, secure user experience. This Privacy Statement sets forth the online data collection and usage policies and practices that apply to www.rminc.com, time.rminc.com, and any other Web site owned, operated, licensed, or controlled by RMI (collectively referred to as the "RMI Web Sites") (unless a different privacy statement is specifically made applicable). By using an RMI Web Site, you consent to the policies and practices described in this statement.

Your data will be stored and processed in whole or in part in the United States. If you access an RMI Web Site outside the United States, your usage of that site constitutes consent to the transfer of your data out of your country and to the United States. RMI web sites contain links to other web sites over which RMI has no control. RMI is not responsible for the privacy policies or practices of other web sites to which you choose to link from an RMI Web Site. We encourage you to review the privacy policies of those other web sites so you can understand how they collect, use and share your information. This Privacy Statement applies solely to the information we collect on an RMI Web Site, and does not apply to information we collect in any other fashion. Health information protected by HIPAA (Health Insurance Portability and Accountability Act of 1996) is collected and used in accordance with our Policy on the Use and Disclosure of HIPAA-related information.

1. Site Description
In some areas of RMI Web Sites, RMI requests, or may request, that you provide personal information, including your name, address, email address, telephone number, Social Security number, contact information and any other information from which your identity is discernible. In other areas, RMI collects or may collect demographic information that is not unique to you such as your ZIP code, age, occupation and gender. We also gather or may gather certain information about your use of an RMI Web Site, such as what areas you visit and what services you access. Moreover, there is information about your computer hardware and software that is or may be collected by RMI. This information can include, without limitation, your IP address, browser type, domain names, access times and referring web site addresses. If you are a co-employee of RMI, we collect and maintain a variety of personal information about you. This information may be accessed through www.rminc.com/clientservices or through paper forms, or e-forms submitted by your employer. If you are a client of RMI, we collect and maintain information about you and, if applicable, your company and employees. We may make some or all of this information available for you or your worksite administrator's use on www.rminc.com/clientservices. While your account is active, we retain indefinitely all the information we gather about you. Once your Client Service Agreement, Co-Employment Agreement or similar arrangement with RMI is terminated, we retain information in accordance with our Records Retention Policy and as required by law. You have access to much of your personal information through www.rminc.com/clientservices, where you can view and update most of the personal information we maintain.

2. Use of Information by RMI
We do not disclose to third parties your personal information, combined personal and demographic information, or information about your use of an RMI Web Site (such as the areas you visit or the services you access), except as set forth in the following four subparagraphs.

3. Disclosure of Information to Others
We use the information we gather on an RMI Web Site, whether personal, demographic, collective or technical, for the purpose of operating and improving the RMI Web Site and delivering the products and services that we offer. We may use your contact information in order to send you email or other communications regarding updates at an RMI Web Site, such as new features and tools available. The nature and frequency of these messages will vary depending upon the information we have about you.

RMI may also share aggregated anonymous information about visitors to each of its Web Sites with its clients, partners and other third parties so that they may understand the kinds of visitors to RMI's site(s) and how those visitors use the site(s).

4. Changes or Amendments to You
Resource Management, Inc. reserves the right to change or amend any of these TOU at any time at its sole discretion. Any changes or amendments will be effective upon posting notice of the revised TOU on a Resource Management, Inc. Web Site. Your continued use of Resource Management, Inc. Web Sites after any such revisions have been implemented shall be deemed your acceptance of such new terms and conditions. These TOU were last revised on May 17, 2005.

5. Use of Cookies RMI may or may not use "cookies" to help personalize your online experience at certain RMI Web Sites. A cookie is a text file that is placed on your hard drive by a Web page server. Cookies are uniquely assigned to your computer, and can only be read by a Web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenient feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize RMI pages, or register for services at www.rminc.com/clientservices, a cookie helps us to recall your specific information (such as user name, password and preferences). Because of our use of cookies, we can deliver a more personalized site experience. You may have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline all cookies if you prefer. Alternatively, you may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. If you choose to decline cookies, however, that may hinder performance and negatively impact your experience on an RMI Web Site.

However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes.

If we decide to change our Privacy Statement for RMI Web Sites, we will post those changes here so that you will always know what information we gather, how we might use that information, and to whom we will disclose it.

10. California Consumer Privacy Act

This Privacy Notice is for California Residents of the clients of Resource Management, Inc. (“RMI”) and applies solely to those residents who are visitors, users, and others who reside in the State of California (“consumers” or “you”) when you visit the RMI website and provide information defined below or RMI performs its human resources-related services (collectively, RMI’s “Services”). RMI adopts this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

Information RMI Collects

RMI collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, RMI has collected the following categories of personal information from consumers within the last twelve (12) months:

Examples: Name, postal address, Internet Protocol address, email address, Social Security number, driver’s license number, passport number, or other similar identifiers.

Category B – Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) Examples: Name, signature, Social Security number, address, telephone number, fax number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, bank account number, credit card number, debit card number, or any other financial information, physical illness, mental illness or disabilities.

Category C – Protected classification characteristics under California or federal law Examples: Age, ethnicity, citizenship, religion or creed, marital status, physical illness, mental illness or disabilities, gender, veteran status.

Category D – Commercial information Examples: Records of personal property.

Category F – Internet or other similar network activity Examples: Access history and information on your interaction with RMI’s application.

Category I – Professional or employment-related information Examples: Occupation, employer information.

Category J – Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)) Examples: Education level, school attended.

Your Rights and Choices

Access to Specific Information and Data Portability Rights

You have the right to request that RMI disclose certain information to you about its collection and use of your personal information over the past 12 months. Once RMI receives and confirms your verifiable consumer request, it will disclose to you:

Deletion Request Rights

You have the right to request that RMI delete any of your personal information that RMI collected from you and retained, subject to certain exceptions. Once RMI receives and confirms your verifiable consumer request, RMI will delete (and direct its service providers to delete) your personal information from its records, unless an exception applies.

RMI may deny your deletion request if retaining the information is necessary for it or its service providers to:

  1. Complete the transaction for which RMI collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of RMI’s ongoing relationship with you, or otherwise perform its Services for you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with RMI.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to RMI by email at ccpa@rminc.com.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.

You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

RMI cannot respond to your request or provide you with personal information if it cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable consumer request does not require you to create an account with RMI. RMI will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

RMI will try to respond to a verifiable consumer request within 45 days of its receipt. If RMI requires more time (up to 90 days), it will inform you of the reason and extension period in writing. If you are a co-employee of RMI, then RMI will deliver its written response to the email that you provided in the RMI Center or to your work-site employer. If you are not an RMI co-employee, then RMI will deliver its written response by mail or electronically, at your option. Any disclosures that RMI provides will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response that RMI provides will also explain the reasons that it cannot comply with a request, if applicable. For data portability requests, RMI will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

RMI does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If RMI determines that the request warrants a fee, RMI will inform you why it made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

RMI will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, RMI will not:
